| posted: 7/15/2003 at 9:45:30 PM ET I have gone to many websites that offer mp3 streams of popular artists. I know that many of these sites do this illegally because the material is copywrited. However, some of the sites offer mp3 streams that are taken directly from televised performances and concerts (material that was never released commercially). For instance I have visited a Bette Midler site that has streams from many of her concert productions in the 70's. The streams are not great quality and they were obviously recorded by someone in the audience of the concert. I have always wondered how "legal" it is to present these streams over the internet. They are not from albums, soundtracks, or from materials that might be purchased. They seem to exist simply for the die-hard fans who don't mind even a "rough" recording of a favorite artist.
The reason I am asking is this...I have many Bernadete mp3's that I have made for MY OWN ENJOYMENT in the car, at home, etc. I have NEVER shared them before because I am uncertain of the legality of sharing. I have recorded these treasures from a great variety of television appearances, etc. and I really treasure the performances. The quality is not the greatest (I recorded aome of them from old VHS tapes...some of which are 10+ years old) but they are not the worst. The majority of them sound pretty good. I have been a Bernadette fan ever since I saw her in Annie (at the movie theater) when I was a child. I would never want to make money off of her. I am a HUGE fan. I have often wondered if Kevin has ever thought of adding a "sounds" section to his website. I would gladly offer these mp3's to him because I know that it would be the true fans who would listen to and enjoy them. Some of the songs I have are recent (for instance... "Rose's Turn" from the Tony's) and some are older (Bernadette singing "Send in the Clowns" with Sondheim at the piano). I know that Kevin has screen captures from tv appearances, so why not have the sounds to go with them? It is the legality of it that I am not sure of...but would love to be "enlightened" about I also don't know if adding streams is a huge expense. I hope that nobody is offended or thinks that I am trying to exploit Bernadette. I have not mentioned this before because I don't want to offend anyone. I know that some people who visit this board know Bernadette personally. Like I stated before...this is not for my own personal financial gain. I just hate keeping them to myself because I know many other fans would really apprecate having them. I hope this doesn't start a huge debate or arguement...but I would love to hear what you think.

Then I don't see why it would be a legal issue. I mean, its legal for people to record things with thier VCRS and pass that around so I don't see why this would be such a problem. But don't hold me to that...I am not a lawyer or anything LOL
I think its actually really nice of you to even offer up something like that for people who may have never heard the things you've referred to before

With the actual recording, there might be some royalties that need to be paid to ASCAP/BMI for redistributing them again... I'll ask my communications professor who worked in industry and see what he thinks.

| posted: 7/15/2003 at 10:10:16 PM ET That sounds great. Artists like Bernadette and Bette are great in the studio, but I think they really thrive when heard in a "live" setting. Bernadette is an amazing live performer and (in my opinion) these recording really show off her unbelievable talents!

| posted: 7/15/2003 at 10:28:43 PM ET I made the recording by connecting my VCR directly to my laptop. That way any additional sounds (like the kind you would get when using a tape recorder) are eliminated. Of course (like I said) the older recordings are from older VHS tapes...so they are not perfect...but still very easy to listen to.

| posted: 7/15/2003 at 10:40:10 PM ET I didn't know you could do that either. LOL then again, I just recently figured out that I can transfer things from my DVD to my VHS (for my friends that don't have DVD players and want the extra features from things).
Now I want to connect a laptop to my VCR! lol

| posted: 7/16/2003 at 11:01:17 AM ET You simply set it up like you are copying a tape to a tape. Except you connect the VCR to a DVD player instead of another VCR. No it won't work the other way around unless your have a DVD recorder which most people don't in that they only came out a couple of years ago.

| posted: 7/16/2003 at 2:49:50 PM ET Well I have a DVD/VCR combo. When I got my DVD player I wasn't ready to give up having a VCR, and coincidentely the VCR I had was broken. So, I got a machine that had a deck for a DVD and a deck for a VHS (it was like $120 and I don't have to go through the trouble of hooking up wires to record from one to the other).
I considered also buying a recordable DVD player, but those are way too expensive at the moment. I'll wait until the prices go down.
